1. Acceptance of Terms

By accessing and using Kazismata's services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by these terms, please do not use this service.

2. Description of Service

Kazismata is a platform that connects job seekers with employers. Our services include but are not limited to:

• Job posting and application services
• Profile creation and management
• Communication tools between job seekers and employers
• Payment processing for services rendered
• Review and rating system

3. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our service.

Account Responsibilities

• You are responsible for safeguarding the password that you use to access the service
• You agree not to disclose your password to any third party
• You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account
• You may not use as a username the name of another person or entity that is not lawfully available for use

4. User Conduct

As a user of Kazismata, you agree not to:

• Post false, inaccurate, misleading, defamatory, or libelous content
• Violate any laws, third party rights, or our policies
• Use our services if you are not able to form legally binding contracts
• Transfer your Kazismata account to another party without our consent
• Distribute viruses or any other technologies that may harm Kazismata or the interests of users
• Circumvent any technical measures we use to provide the services

5. Job Listings and Applications

For Employers

• You must provide accurate information about job opportunities
• You agree to respond to applications in a timely manner
• You are responsible for the selection and hiring process
• You agree to pay for services rendered as agreed upon with the worker

For Job Seekers

• You must provide accurate information about your skills and experience
• You agree to perform work to the best of your ability
• You are responsible for completing work as agreed upon with the employer
• You agree to communicate professionally with employers

6. Payment Terms

Kazismata may charge fees for certain services. All fees are in Kenyan Shillings unless otherwise stated.

Service Fees

• We may charge a service fee for successful job placements
• Payment processing fees may apply
• All fees are non-refundable unless otherwise stated

Payment Disputes

If there is a dispute regarding payment, please contact our support team. We will work to resolve the dispute in a fair manner.

7. Intellectual Property

The service and its original content, features, and functionality are and will remain the exclusive property of Kazismata and its licensors. The service is protected by copyright, trademark, and other laws of both Kenya and foreign countries.

8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the service will immediately cease. If you wish to terminate your account, you may simply discontinue using the service.

9. Limitation of Liability

In no event shall Kazismata, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the service
• Any conduct or content of any third party on the service
• Any content obtained from the service
• Unauthorized access, use or alteration of your transmissions or content

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect.

By continuing to access or use our service after those revisions become effective, you agree to be bound by the revised terms.
